Your use of the website atwww.everybodytalks.co.uk/ (Website) and/or the ordering of any product from Everybody Talks Limited creates a legally binding contract between you and Everybody Talks subject to these terms and conditions.

These terms and conditions incorporate any of the information or terms set out on pages on the Website linked to in these terms and conditions.

While Everybody Talks endeavours to ensure that no viruses or malicious software are contained on the Website, Everybody Talks makes no warranty as to your use of the Website and Everybody Talks will have no liability for any damage to your computer or other hardware as a result of your use of the Website.

You may not make use of any logo or trademark displayed on the Website without the express written consent of Everybody Talks. You may link to the Website from any other website provided that you agree to immediately remove that link if requested by Everybody Talks.

Everybody Talks Ltd reserves the right to make changes to the Terms and Conditions and the website.

By placing an order on the website, you accept Everybody Talks Ltd Terms and Conditions and will be subject to those in force at the time of your order.

If for any reason any of these Terms and Conditions is deemed invalid, void or unenforceable, the validity and enforceability of any remaining condition shall not be affected.

The Website contains links to websites that are not controlled by Everybody Talks (Third Party Website). Everybody Talks makes no promises or warranties as to the content or security of any Third Party Website and you link to and use any such Third Party Website at your own risk.

Subject to any relevant consumer protection legislation including our obligation under the Consumer Protection (Distance Selling Regulations) Everybody Talks will not be liable for any:

  • Warranties, conditions and representations whether express, implied, statutory or otherwise, relating in any way to the Website, your use of the Website and the information, products supplied, offered to be supplied or advertised or accessed through the Website; and
  • Liability (including for negligence) to you or anyone else in respect of any loss or damage (including special, indirect or consequential loss or damage), costs and expenses suffered by you or claims made against you arising from or in connection with your use of the Website and the information, products supplied, offered to be supplied or advertised or accessed through this Website for any reason whatsoever (including negligence).

Everybody Talks’ maximum aggregate liability for any product supplied to you whether, in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount paid by you to Everybody Talks in respect of the product excluding any amount paid for delivery.

All products ordered by you are supplied on an “as is, where is” basis and Everybody Talks makes no warranty as to the suitability or efficacy of any product beyond any manufacturer warranty included with the product.

No information on the Website is intended to be taken as medical advice and is intended only for information purposes.

Always read the label of any product carefully and use only as directed. If you are very concerned your child’s language or speech is not developing as expected, they are experiencing significant distress as a result of their difficulties, or you have concerns about your own language, you should consult a Qualified Speech and Language Therapist for assistance.

This agreement is governed by English law. You hereby irrevocably submit to the exclusive jurisdiction of the English courts notwithstanding the jurisdiction where you are based.

If you wish to cancel your order you may do so, so long as cancellation is made before the goods are dispatched.

Everybody Talks will endeavour to deliver all orders made by you on the Website but reserves the right to refuse to deliver any products ordered for any reason, including without limitation, unavailability of stock or a decision by Everybody Talks to no longer sell a product.

All prices for products on the Website are exclusive of VAT. Credit/Debit Card

We accept Visa and Mastercard payments (provided by Gateway TBC) – it’s fast, easy and secure. Payment by credit or debit card is the best way to ensure your order gets to you as fast as possible.

Direct Credit / Internet Banking

You can also pay directly into our account – your order will be sent once the payment has cleared. Just select this option during the checkout process and our account details will be provided. Please make payment within 24 hours of order to prevent your order being cancelled.

All United Kingdom orders are sent by Royal Mail (signed for).

We aim to deliver within 14 working days of receiving your order.

Please contact us within 30 days of placing your order, if it has not arrived and we will endeavour to resend it once we have investigated with Royal Mail what happened to delivery (note, we use their ‘signed for service’ in all deliveries).

Where there is a delay or failure to deliver goods, that is due to circumstances beyond our control, Everybody Talks Ltd shall not be liable. This condition does not affect your statutory rights.

Customers who are VAT exempt or zero-rated must provide copies of appropriate documentation, endorsed by Customs & Excise, in order for VAT not to be charged on a consumable product.

Most of the resources we sell fall within the Large Letter or Small Parcel Definition. Charges for these are:

Large Letter: £3.24 + £1.00 packaging

Small Parcel: £3.90 + £1.50 packaging.

Multiple item orders may incur an extra charge due to weight and size. We will advise you of the postage and packaging costs as soon as possible.

Educational Settings who contract Speech and Language Services from us incur no Postage and Packaging costs as we will arrange delivery to your Therapist. All UK deliveries are sent using the ‘signed for’ delivery option.

P.O. Boxes

We deliver to P.O Boxes at no additional charge. If your order is too big for your P.O Box, Royal Mail will hold it at their depot for collection.

International Shipping

We do not offer international shipping at this time.

Missing or damaged parcels

All products are tested before they are sent to our customers to ensure they are in good and/ or working condition.

Where damage or defect has occurred to goods that is due to circumstances beyond our control, Everybody Talks Ltd shall not be liable. This condition does not affect your statutory rights.

Please take a photo of the items as you are opening packaging to support any claim you may have with regards to damage to the products in transit. Without this evidence, we may not be able to support any claim you may have with Royal Mail.

Please keep any packaging and damaged items as they are received, as these are required for the claim process.

If the products you receive are faulty or damaged, contact us within 7 days of receiving the goods, with photo evidence, and we will open an investigation with Royal Mail on your behalf.

With all queries to our Customer Support Service, invoice numbers should be quoted. Please note that we are unable to accept returns for any reason other than damage to the items.

In the unlikely event that your parcel doesn’t reach you within the expected delivery time-frame (15 working days max) of our having emailed you confirmation of dispatch, please let us know.

  • For us to be able to assist you with regards to a missing parcel please contact us within 90 days of your parcel’s dispatch.
  • After this times we may, unfortunately, be unable to assist you.

Disclaimer

We’ll do our absolute best to get your order to you within our specified delivery period. There may be complications with your order or with delivery in your area. Contact us if you have problems and we’ll do our best to help.

On occasion, items may be stolen or go missing. We do our best to track them down but we can’t control what happens once your parcel leaves the Everybody Talks office. To be safe, we always use the ‘Signature Required’ option.

If your parcel is returned to us for whatever reason, we will need to charge a fee to send it again. Please check that there is a safe place for Royal Mail to leave your parcel and that the address you have provided is correct.

Please make sure that you answer any Card To Call requests from Royal Mail in a timely manner to avoid parcels being returned.

We want to you love everything you buy from Everybody Talks so please do not hesitate to contact us with any problems.

If your item arrives broken or faulty, please contact us within 10 days of purchase. We will offer the option of a full refund or replacement if the item has arrived faulty. Unfortunately, we can not guarantee a refund of the cost of posting your items back to us but may offer this at our discretion.

Please choose your items carefully as we can not offer refunds or replacements due to ‘change of mind’ purchases, only in the instance where the item has arrived broken or faulty.

Please keep all original packaging if there is an issue with your order. If you receive an incorrect item, please do not open or use it, we can not process returns on used items.

If you wish to cancel an order before it is shipped, please email or phone us. If we are able to catch it in time, we will issue a store credit for the value of the order. Unfortunately, orders that are already with Royal Mail cannot be cancelled. Please think carefully before placing your order.

Please note also that colours shown are an indication only and often appear different between different computers & phones.
